Mr. Justice Weatherill released Reasons for Judgment recently for injuries being claimed for a motor vehicle accident that occurred in May 2009.
This motor vehicle accident saw a Smart Car make a left turn into the path of a sedan driven by Sharon Brown. Both vehicles were written off. ICBC denied liability and denied the extent of Ms. Brown’s subsequent injuries and particularly how the injuries will affect her in the future.
At trial, the Judge gazed in to the “crystal ball” and awarded $150,000 to Ms. Brown, a 63 year old woman, for her future loss of earnings with respect to, what the judge decided was a possibility, the likelihood of her having to retire early. The judge stated: “It is impossible to predict the future and impossible to precisely know how many months or years the plaintiff’s working career will be shortened, but I am satisfied that it will be.”
The judge also awarded over $40,000 for her future care costs, including $5,000 for a mechanical bed, $12,000 for future housecleaning services and $2,000 for future medications.
